Step-by-step plan for a patent application
The steps for applying for a patent right are further specified below.
In a no-obligation meeting at our office in Enschede or Heerenveen, or via telephone or video connection, we will discuss with you whether your invention is eligible for patent protection. During the interview you can explain your invention to us, for example by means of a prototype, video, a sketch or just an oral explanation. In any case, we will keep asking questions until we understand what it is all about.
2. Exploratory novelty search
An exploratory novelty search can be conducted to gain insight into whether your invention is eligible for the patent application. In this research, we search a specialized database for publications in the field of the invention. Based on the publications found, an estimate is then given of the possibilities for a patent application for your invention. The costs for an optional exploratory novelty search are € 895 excluding VAT.
3. Write patent application
Before a patent right can be applied for, a patent application must be written. A patent application consists of a description explaining the state of the art and the invention. Writing the text is specialist work and we do it for you based on the information we receive from you. Inaday is a specialist with years of experience in applying for patent law. We can even write your request within one business day, if necessary. For questions, see our article: “In one day: how is it possible?”. The rates for writing a patent application are as follows:
€ 4,750 excluding VAT for a delivery time for the first concept of 1 working day
You will receive a 10% discount if we are allowed to deliver the first concept within 3 working days (€ 4,750 minus 10% discount = € 4,275)
You will receive a 20% discount if we are allowed to deliver the first concept in 10 working days (€ 4,750 minus 20% discount = € 3,800)
4. File a patent application
As soon as you agree with the text of the patent application, the patent will be applied for at the Dutch Patent Center or the European Patent Office. The rates for filing a patent application are as follows:
€ 180 at the Dutch Patent Center (including an official national novelty search)
€ 874 at the Dutch Patent Center (including an official international novelty search)
€ 1,475 at the European Patent Office (including an official international novelty search)
Your invention is protected from the moment your patent application is filed. After submission, you have a year to investigate the potential of your invention and arrange further protection. The protection is valid worldwide, provided you submit further applications in the different countries within one year.
The Patent Office or the Patent Office will have the report of the official novelty search available after 6 to 9 months. Inaday will report this to you and advise you on what protection is possible for your invention based on the filed patent application. The costs of this report are:
EUR 895, – excluding VAT for reporting and advising on the report of the official novelty search.
