When Can a Trademark Be Registered?

Not every name or logo qualifies for trademark registration. A trademark must satisfy a number of legal requirements before it can be accepted for registration.

The Trademark Must Be Distinctive

The most important requirement is that the trademark has distinctive character. In other words, it must enable consumers to distinguish your goods or services from those of other businesses.

Invented words such as Google, Kodak, and Spotify are inherently distinctive. Existing words may also be distinctive if they bear no direct relationship to the relevant goods or services, such as Apple for computers.

The Trademark Must Not Be Descriptive

A trademark may not merely describe the goods or services, their characteristics, or their intended purpose.

For example, names such as "Fresh Bread" for a bakery or "Fast Moving" for a removal company would generally not qualify for trademark registration. Such descriptive terms must remain available for all businesses operating in that sector.

The Trademark Must Not Be Misleading

A trademark must not mislead consumers regarding the nature, quality, or geographical origin of the goods or services.

The Trademark Must Not Be Contrary to Public Policy or Accepted Principles of Morality

Trademarks that are offensive, discriminatory, encourage violence, or otherwise conflict with public policy or accepted principles of morality cannot be registered.

There Must Be No Earlier Conflicting Trademark Rights

Even if your trademark meets all of the above requirements, earlier trademark rights may still prevent registration. A trademark that is identical or confusingly similar to an earlier registered trademark covering the same or similar goods or services may result in opposition proceedings or a trademark infringement claim.
